- DEFINITIONS
“SELLER” is the website www.coffeeshopbg.com, which is owned by „NIKI 17“ EOOD and serves as a virtual platform for the sale of goods. The seller is the person with whom the User concludes a contract for the distance sale of a specific product (item) in the online store.
“USER” is a person with legal capacity who has agreed to these General Terms and Conditions in connection with the application and purchase of the goods offered in the online store.
“ONLINE STORE” is the website www.coffeeshopbg.com, which serves as a virtual platform for offering goods for sale and for reaching an agreement between the SELLER and the USER for the order and purchase-sale of a specific good (item).
„NIKI 17“ EOOD is the commercial company, with registration number: 204468920, with its headquarters in the city of Stara Zagora, 5 Balgarsko Opalchenie, which creates and maintains the online store, offers and sells goods in the store and defines the present General Terms and Conditions, under which sell the goods. „NIKI 17“ EOOD has full rights to unilaterally change the content of the Internet site, as well as the methods of access to it.
“ORDER” is the request made by the User to the online store for the purchase of one or more specific goods (items). The order is packed and sent by courier to the address previously specified by the User in the order, after it has been approved by e-mail or phone. Email approval is done by sending an email (electronic letter) for confirmation. Approval by phone takes place after a call from an employee of the online store for confirmation.
“SALE AGREEMENT” is the contract for the purchase and sale of goods between the Seller and the User concluded at a distance through this online store.
“COURIER” is a trader who physically delivers the purchased goods to the address specified by the User and works under the requirements of the Postal Services Act.
“BROCHURE / ANNOUNCEMENT” are electronic informational messages relating to goods sold in the online store during a certain period of time, which may be placed on the Internet page, and may also be sent by e-mail to the User.
- TERMS OF USE OF THE ONLINE STORE
2.1. Browsing the online store www.coffeeshopbg.com is completely free and accessible from anywhere in the world.
2.2. In order to shop at the online store www.coffeeshopbg.com, registration with a password and e-mail or the recipient’s name, e-mail, phone and delivery address is required. Registration is completely free and is done by filling out the registration form. The registered customer has the opportunity to use all the services of the store.
2.3. The user must specify e-mail and password, personal data and delivery addresses.
2.4. „NIKI 17“ EOOD is a registered administrator of personal data within the meaning of the Personal Data Protection Act (PDPA) and has the right to collect, process and use the personal data of its users in view of the needs of the online store, while at the same time having the obligation to protect to keep these personal data confidential, not to use them for other purposes, nor to provide them to third parties, except for Sellers in the store.
2.5. In the online store www.coffeeshopbg.com, the price, the main characteristics of the product and additional information, aimed at helping to make an informed choice when purchasing the product, are indicated for each product. Also, on each page of a presented product, there is an opportunity for Users of www.coffeeshopbg.com to give opinions and evaluations regarding the given product.
2.6. All prices indicated on the site are in BGN with VAT included.
2.7. On the page to the right next to each product is a “BUY” button. Pressing the “BUY” button saves the selected product in the User’s virtual shopping cart. The contents of the cart are saved until the User decides to proceed with the purchase of the goods. By pressing the “View Cart” button, the user can view the contents of the virtual shopping cart, add new products or remove those he does not want. After pressing the “Continue with the order” button, the customer details and delivery details appear. The order is activated by pressing the second “Order” button.
- ORDER OF GOODS
3.1. In order to place an order to the online store, the User must specify:
3.1.1. a valid e-mail address;
3.1.2. correctly completed address for delivery of the goods and invoicing;
3.1.3. correctly filled contact details – two names, phone.
3.2. The order is activated, i.e. apply to the e-shop by pressing the second button “Order” – located under the delivery data of the order, which button appears after at least one product has been added to the basket and the first button “BUY” has been pressed.
3.3. . Upon successfully placing an order, the User receives confirmation of the order by e-mail to the e-mail address indicated by him or SMS to the mobile phone number indicated by him. The e-mail confirmation indicates the ordered goods, the order number, the date and time the order was placed. When an order is successfully placed, an SMS is sent to the specified mobile phone number with information about the order number and how many working days the delivery will take. Telephone confirmation is only carried out if additional information or clarification regarding the order is required.
3.4. In the event that the ordered product (specific model) is not available, the consultant notifies the User. If the User does not agree to the order being referred to another product (similar model), the order may be cancelled.
3.5. Orders in the online store www.coffeeshopbg.com are accepted 24 hours a day, 7 days a week.
3.6 The working hours of the consultants of the online store www.coffeeshopbg.com are:
From Monday to Friday from 08:30 to 16:30.
Day off: Saturday and Sunday
3.7. Orders received without correct data of the buyer (User) or missing data are canceled if the Seller does not receive the correct data within 48 hours after the order is placed. Such orders receive the status “REJECTED”, due to the impossibility of being fulfilled.
3.8. The user can refuse an order made without the need to mention reasons for the refusal.
3.9. An order can be canceled by phone. For the refusal to be valid, the User must provide: the number of the order placed, the telephone number left in the order, the two names with which he is registered on the site, the e-mail address (e-mail) with which he is registered on the site, the price of the order.
- DELIVERY OF ORDERED GOODS
4.1. After an order is received by a User at www.coffeeshopbg.com, the automated system of the online store notifies the User by email or SMS about the successfully accepted order.
4.2. Delivery is made only to successfully accepted orders.
4.3. Delivery of ordered goods is not carried out on Sundays and public holidays.
4.3.1. Ordinary delivery – within 4 (four) working days from the moment of confirmation of the order.
4.4. The seller uses a courier company “Speedy” or “Ekont” for deliveries, and the usual delivery hours are from 9:00 a.m. to 5:30 p.m.
4.5. Delivery is made to an address exactly specified by the User (regardless of whether residential or business) or to an office of “Speedy” or “Econt” in the relevant city.
4.6. Shipping prices are described on each product’s page in the “Shipping”
column 4.7. Each shipment is insured, and the insurance is at the Seller’s expense.
4.8. If the User does not provide access and conditions for delivery of the goods to the specified address within the specified time or does not go to the specified office of “Speedy” or “Ekont” to receive the goods in time, if he has chosen this option, the Seller is released from the obligation to fulfill the requested delivery.
- PAYMENT
5.1. The payment of the ordered goods can be made in two separate ways or in combination with each other, as regardless of the selected payment method, the payment amount is the same and no additional fees are charged for processing the payment.
5.1.1. With “cash on delivery” – payment in cash to the courier upon delivery;
5.1.2. With a VISA or Master Card credit/debit card;
5.2. For each ordered product, the user must pay the price that is announced in the online store at the time of the order plus the price for delivery. The price of each commodity can change dynamically.
- WAIVER OF CONTRACT. COMPLAINT
6.1. The user has the right to claim or return goods purchased from the online store within 14 days of receiving the goods.
6.2. A cancellation of the contract can also be made before the courier upon delivery of the goods, if the goods were delivered after the deadline for reasons beyond the User’s control and not due to force majeure.
6.3. In case of cancellation of the contract, the User is obliged to return the purchased goods in an undamaged commercial form and with a preserved label.
6.4. In case of cancellation of the contract, if the User has paid for the goods, he will be refunded the amount paid for the returned goods to the bank account indicated by him within 14 /fourteen/ days after the return of the goods. Amounts are not refunded until the User returns the goods. If the goods are not returned within the period under item 6.1, the withdrawal from the contract has no effect.
6.5. A complaint is made when the purchased goods do not correspond to what was agreed between the parties to the sales contract. The inconsistency in what was agreed between the parties can be expressed in:
manufacturing defects of the goods;
detected missing parts of the goods;
the wrong product was sent, different from the one ordered;
damage to the goods during transportation.
6.6. The complaint can be submitted to „NIKI 17“ EOOD on the indicated telephone number +359 879 381 380, and at the same time the User must return the goods within 14 days.
6.8. In the event of a complaint, the User may choose to exchange the specific item for the same one without defects or in a different size, or return the item for a refund of the amount paid. An e-store consultant may offer to replace the item with a completely different item when the prices are equalized – either the User pays extra if the other item is more expensive, or two items are offered for the same price, or the User is refunded the difference between the replaced items and the new item if the price of the new item is lower than the price paid by the User.
6.9. The return of the goods in the event of a complaint, in cases other than a factory defect or damage during transport, is carried out under the following conditions:
Retained good commercial appearance.
No damage caused by improper use.
Original packaging and label preserved.
6.10. The return of goods, either in case of cancellation of the contract or in the case of a complaint, can be made in the manner and at the address indicated on the goods receipt with which the User received the order.
6.11. In case of exchange of goods, the transport costs are at the expense of the User in both directions, unless the exchange was necessary due to the fault of the online store. In the event that the customer wishes to exchange or return a product, this can be done with the courier company “Speedy” or “Ekont”.
In the event that there is no office of the courier company “Speedy” or “Ekont” in the User’s place of residence, he must contact the Seller by phone +359 879 381 380 to clarify the details of returning the goods.
- TERMS FOR COPYING INFORMATION
7.1. All information published on the site www.coffeeshopbg.com is the property of „NIKI 17“ EOOD, including pictures and descriptions of items. The online store gives the right to owners of other sites and users to publish links to the online store www.coffeeshopbg.com.
7.2. It is forbidden to copy texts from www.coffeeshopbg.com and place them in other websites and online stores without the written consent of „NIKI 17“ EOOD or to cite the source by inserting the following text: “Source: online store for coffee www.coffeeshopbg.com ”, as an online coffee shop www.coffeeshopbg.com should be a link to www.coffeeshopbg.com.
- LIABILITY
8.1. The Seller of the goods is responsible for the defects of the goods, for the fulfillment of the distance sales contract, as well as for the refund of paid sums. He is obliged to provide, along with the goods, information on paper to assist the User in exercising his rights.
8.2. „NIKI 17“ EOOD does not bear any responsibility towards third parties, if such a person believes that information published on the online store violates someone’s copyright or other intellectual property rights.
- BROCHURES AND NOTICES
9.1. When a User registers in the e-shop by creating a Profile on the Website, accepting the General Terms and Conditions, he agrees to receive brochures and/or notices from „NIKI 17“ EOOD, as well as messages regarding orders, to his e-mail and mobile phone of goods and confirmations to change its data.
9.2. The User may opt out of receiving brochures and/or notifications by email and mobile phone at any time:
9.2.1. By using the specially made Internet link contained in each brochure and/or notice – the “unsubscribe” button.
9.2.2. By contacting „NIKI 17“ EOOD at the indicated email info@coffeeshopbg.com with an express request to refuse to receive brochures and/or notifications.
9.3. If, after opting out of receiving brochures and/or notifications, the User places an order, it is considered that he has again agreed to receive brochures and/or notifications.
9.4. „NIKI 17“ EOOD reserves the right to choose to whom to send brochures and/or notifications, as well as to remove from its database a User who has given his consent to receive brochures and/or notifications.
9.5. „NIKI 17“ EOOD includes in the brochures and/or notices only advertising information relating to goods sold in the store.
